POSITION
about membership in the Public Organization
“THE WAY OF PEACE”
- GENERAL PROVISIONS
1.1. This Regulation on the membership of the NGO “WAY OF PEACE” on a par with the Charter of the NGO “WAY OF PEACE”, hereinafter respectively, “Regulations” and “Public Organization”, is the main document and determines membership in the NGO “WAY OF PEACE”
1.2. This Regulation clarifies and supplements the Charter of the Public Organization on the conditions of membership and cannot contradict it.
1.3. Membership in the Public Organization implies that the Public Organization has candidates for members, as well as associated (without the right to vote) and full (full) members.
1.4. Full members of the NGO “WAY OF PEACE” may be legal entities that wish to participate in the implementation of the tasks and goals of the Public Organization and recognize the provisions of the Charter and other documents of the Public Organization.
1.5. The decision on admission to the members of the Public Organization is made by the Council of the NGO “WAY OF PEACE” on the basis of a written application of the Candidate for members of the Public Organization.
When submitting an application, the future member of the Public Organization should get acquainted with the Charter, the main Provisions of the NGO “WAY OF PEACE” with the internal documents of the Public Organization, and those programs that are carried out within the framework of its activities.
From the moment of submitting an application for admission to a member of a Public Organization, this legal entity becomes a Candidate for members of the Public Organization.
2. CONDITIONS AND PROCEDURE FOR OBTAINING MEMBERSHIP IN A PUBLIC ORGANIZATION
2.1. Admission to the members of the Public Organization is carried out on the basis of a personal application. Admission to the participants of the Public Organization is carried out on the basis of an application of a legal entity of private law, which is signed by an authorized person who has the right to represent a legal entity in accordance with applicable law.
2.2. The decision to admit new members to the full members of the Public Organization is made at a meeting of the Council of the Public Organization.
2.3. Associate members of the Public Organization can be any non-profit associations of legal entities that recognize the Charter of the Public Organization, share its purpose and are able to join the implementation of the goals and objectives of the Public Organization. Associate membership excludes the right to vote in resolving issues related to the organization and management of the Public Organization.
2.4. To join as an associate member of the Public Organization, the organization submits a corresponding application addressed to the Chairman of the Council of the Public Organization and an Information Certificate on the activities of the organization.
2.5. For admission to the full members of the Public Organization, the candidate shall submit:
- Statement of the candidate for members of the NGO “WAY OF PEACE”
- Information certificate on the activities of the organization (free form).
- Letters of recommendation from members of the Public Organization (at least two; certified by the seal and signature of the heads of the recommended organizations).
2.6. The admission of new full members of the Public Organization takes place after consideration of the submitted documents and the presentation of the organization at a meeting of the Council of the Public Organization. The decision is made by voting by a simple majority of the votes of all present members of the Council of the Public Organization.
2.7. The decision can also be made by electronic voting of the members of the Council of the Public Organization. Such a decision is drawn up by the minutes of the next meeting of the Council of the Public Organization with the specified date of accession, which corresponds to the date of completion of electronic voting.
2.8. In case of negative and contradictory responses about the organization, a candidate for a member of a Public Organization, one way or another, may be accepted as an “associated” member of the Public Organization if more than 4/5 of the present members of the Council of the Public Organization vote for this decision. Subsequently, an organization can receive the status of a “full” member of the Public Organization under conditions of active participation in its activities.
2.9. Within 7 days from the date of voting, the Chairman of the Council of the Public Organization draws up a protocol and informs the candidate’s organization about the admission to the membership of the Public Organization.
2.10. A full member of the Public Organization is issued a Certificate of membership in the NGO “WAY OF PEACE” after full payment of the entrance fee and the first membership fee.
- REQUIREMENTS FOR MEMBERS OF THE ASSOCIATION
3.1. Members (participants) of the Public Organization take part in its activities on a voluntary basis.
3.2. The following requirements are imposed on the members (participants) of the Public Organization:
3.2.3. Share the purpose of the Public Organization and make efforts to achieve it and fulfill the tasks of the Public Organization;
3.2.4. Adhere to and rely in their activities on the principles of the Expert Code of Ethics and the rules that determine the expert and the professional community.
3.2.5. Comply with the Statute of the Public Organization and fulfill the obligations assumed by the Public Organization in agreements, contracts, etc.;
3.2.6. To ensure, in accordance with the terms of the Charter, full in scope and timely performance of the undertaken duties;
3.2.7. Implement the decisions of the governing bodies of the Public Organization;
3.2.8. Not to take actions that may harm the activities or reputation of the Public Organization;
3.2.9. To pay in a timely manner and in full entrance and membership fees in accordance with the procedure established by the Council of the Public Organization.
3.3. None of the members of the Public Organization may transfer to third parties, in whole or in part, their rights and obligations without a corresponding decision of the Council of the Public Organization.
- RIGHTS AND OBLIGATIONS OF MEMBERS OF A PUBLIC ORGANIZATION
4.1. A full member of the Public Organization has the right to:
4.1.1. Make proposals in the order of the day of the General Meeting of members of the Public Organization and take part in the General Meeting of members of the Public Organization with the right to vote.
4.1.2. Propose the creation of permanent or temporary working bodies of the Public Organization (specialized commissions, committees, projects, working groups, sections). Participate in the work of such bodies and lead them.
4.1.3. Participate in informal events of the Public Organization, subject to payment of all or a share of the cost of participation.
4.1.4. Use the capabilities and resources of the Public Organization to protect their rights, interests before public authorities and other organizations, enterprises and institutions. Use the legal assistance of the Public Organization and/or its members.
4.1.5. Use the benefits and discounts that are presented to members of the Public Organization.
4.1.6. Use all materials, documents and library of the Public Organization.
4.1.7. Use the logo and/or brand name of the Public Organization on its forms, business cards, etc. with the text “Full member of the NGO “WAY OF PEACE”
4.1.8. Post information about your company on the website of the Public Organization, post company news in the news feed of the PUBLIC ORGANIZATION website.
4.1.9. Receive news and bulletins of the Public Organization, access to the closed area of the website.
4.2. Full members are required to:
4.2.1.Participate in the activities of the Public Organization. In its activities, if it concerns the Public Organization, be guided by the Statute of the NGO “WAY OF PEACE” by this Regulation and other internal documents of the Public Organization.
4.2.2.Pay membership fees to the Public Organization in a timely manner.
4.3. The duties of candidates for members of the Public Organization do not differ from the duties of a full member of the Public Organization specified in the Charter of the NGO “WAY OF PEACE”.
4.4. Candidates for members of the Public Organization, as well as associated members of the Public Organization in accordance with this provision, have the right to:
4.4.1. Participate in the programs of the Public Organization on the same rights as full members of the Public Organization.
4.4.2. Participate in the work of the General
meetings of members of the Public Organization and Internet conferences held by the Public Organization without the right to vote.
4.4.3. Purchase products on preferential terms and receive services from enterprises owned by the Public Organization.
4.4.4. Receive material and other assistance from the Public Organization, including to protect their economic and other interests, advanced training, and education of their employees.
4.4.5. Use the open database of the Public Organization.
4.4.6. Publish their works in the publications of the Public Organization.
4.4.7. Terminate the trial period early and leave the Public Organization.
- TERMINATION OF MEMBERSHIP IN A PUBLIC ORGANIZATION
5.1. Termination of membership takes place on the basis of a decision of the Council public organization.
5.2. Membership in the Public Organization is terminated due to:
5.2.1. providing a member of the Public Organization with a notice of withdrawal from the Public Organization (no later than two months before leaving the Public Organization);
5.2.2. termination of the activity of a member of the Public Organization in accordance with the legislation of Ukraine, from the moment of occurrence of such an event;
5.2.3. non-fulfillment by a member of the Public Organization of the obligations stipulated by the Statute and internal regulations of the Public Organization, including through the actions of a member of the Public Organization, which caused damage to the business reputation of the Public Organization or its members
5.2.4. The exclusion of a member of the Public Organization for non-fulfillment of statutory requirements, non-payment, systematic untimely, or not in full payment of membership fees, is carried out by decision of the Council public organization on the proposal of the Chairman of the Council of the Public Organization.
5.3. In case of termination of membership in the Public Organization, the property and funds contributed by a member of the Public Organization for the needs of the Public Organization during the membership period, including in the form of entrance and membership fees, are not returned.
5.4. The decision to refuse admission to members and expulsion from members may be appealed in accordance with the legislation of Ukraine.
- MEMBERSHIP FEES
6.1. The amount of membership fees for members of the NGO “WAY OF PEACE” and the procedure for their payment is established by the decision of the General Conference of members of the NGO “WAY OF PEACE”
6.2. The amount of membership fees for members of the NGO “WAY OF PEACE” and the procedure for their payment are defined in the Regulations on contributions to the NGO “WAY OF PEACE”
6.3. Within 7 (seven) working days from the date of notification of the Candidate’s admission to the Public Organization as an associate or full member of the Public Organization, the latter is obliged to make an entrance fee in the amount determined by the General Conference.
- FINAL PROVISIONS
7.1. Amendments to this Regulation are adopted by a qualified majority of at least 2/3 (two-thirds) of the number of votes of the members of the Council of the Public Organization.
7.2. Changes to this Regulation come into force from the moment of the decision of the members of the Council of the Public Organization. Members of the Public Organization are informed about all changes and additions that are made to this Regulation within 10 (ten) working days from the date of adoption by the General Conference of members of the NGO “WAY OF PEACE” of the relevant decision by phone, fax, e-mail or publication of such information on the official website of the Public Organization.
7.3. All issues that are not regulated by this Regulation are regulated in accordance with the Statute of the NGO “WAY OF PEACE” and the legislation of Ukraine.
7.4. This Regulation is binding on all members of the Public Organization.
7.5. This Regulation comes into force from the moment of approval at a meeting of the Council of members of the Public Organization.
7.6. This Regulation is published on the website of the NGO “WAY OF PEACE” within 10 (ten) working days from the date of its approval.
